Lee's Industries Class Action

If you are a current or former home health worker for Lee’s Industries, Inc. (including Lee’s Home Health Services and Lee’s Companies) between January 17, 2004 and the present, you may be part of the class action lawsuit described herein.

 


Class Action Background

On January 17, 2007, Plaintiffs Tracy Bishop, Pamela Brooks, Peggy Cunningham and Natividad Reyes filed suit in the Philadelphia Court of Common Pleas on behalf of themselves and others similarly situated against Lee’s Industries, its related companies, and managers Nina Kinard and Eric Lamback.


Plaintiffs allege that Lee’s Industries, Inc. has not paid its hourly home health aides for travel time between clients and for overtime as required by Pennsylvania law. Plaintiffs seek money damages for back wages, interest, and liquidated damages based on their claims.  Plaintiffs also seek future correction of pay practices, including payment for travel time and overtime, and payment by defendants of attorneys’ fees and costs.


On October 23, 2009, Judge Gary DiVito certified a class in the action consisting of:


All non-supervisory home health workers employed by defendants and/or any defendant, including but not limited to home health aides, certified nursing assistants, homemakers or direct care workers, or any other employees of defendants and/or any defendant providing care at home to any client of defendants and/or any defendant.    (Copy of Order, click here)


Plaintiffs estimate that the class consists of at least 730 and possibly more than 1,000 home health workers who were not paid for travel time and/or overtime while employed by Lee’s Industries and related companies. Notice was mailed to some Class Members on June 16, 2010, and to additional Class Members on March 16, 2011.  To view the Notice, click here.
